The KwaZulu-Natal High Court in Durban has handed down a life sentence to Sphamandla Siyalo Khumalo for the murder of his former partner, Nomfundo Thandiswa Nomonde Msibi in August 2024.
Msibi, 30, was a mother to their shared child and described as being warm and caring. However, her relationship with Khumalo had ended prior to the fateful day, leading her to limit contact with him while starting a new relationship.
On 4 August 2024, Khumalo's brother approached Msibi, asking her to meet him at the Gateway Shopping Centre to lay bye clothing for their child. In a bid to protect herself from Khumalo, she asked her boyfriend to accompany her to the mall.
The situation escalated when Msibi and her boyfriend were separated at the shopping centre. An argument erupted between Msibi and Khumalo regarding payment issues before they proceeded to the public transport rank. It was there that Khumalo, armed with a knife, launched a brutal attack on Msibi, stabbing her multiple times as she attempted to flee. Eyewitnesses watched in horror as he continued to assault her, ultimately leading to her death. Khumalo was apprehended by authorities on the scene.
In court, advocate Krishen Shah presented a Victim Impact Statement compiled by Msibi's brother, facilitated by Court Preparation Officer, Thandeka Nadi Mofokeng. Msibi's brother described her as a humble and caring individual, whose loss has inflicted significant trauma on their family.
During sentencing, the judge emphasised the seriousness of the crime, declaring Khumalo unfit to possess a firearm. The National Prosecuting Authority welcomed the life sentence, indicating that such rulings signal a firm commitment to combatting gender-based violence and ensuring justice for victims.
