The High Court in Johannesburg has drawn a firm line in an interim maintenance dispute, placing the full financial weight on the father's shoulders while making sure the child's life stays stable and consistent in the mother's care.
The court said, "The minor child shall reside with the applicant, and the applicant shall be the primary caregiver to the minor child." This brings immediate certainty and removes any room for dispute about where the child belongs while litigation unfolds.
Father carries full financial responsibility
On accommodation, the court directed, "The respondent shall pay rental for accommodation for the applicant and minor child up to an amount of R30 000 per month," placing the responsibility for securing and funding housing squarely on the father.
The obligation extends beyond shelter. The court further ordered, "The respondent shall ensure that the residence is furnished with necessary furniture and appliances," reinforcing that the standard of living must be maintained, not reduced.
Transport is treated as essential. The court stated, "The applicant shall have the exclusive use of the Haval H6 HEV motor vehicle currently in her possession," and added that the father must cover "insurance, licensing, servicing, maintenance and tyre replacement," ensuring uninterrupted mobility.
Medical care obligations are equally strict. The court ordered, "The respondent shall retain the minor child on his current medical aid or a similar scheme with gap cover," and further directed that the father is liable for "all reasonable and necessary medical expenses not covered by the medical aid." To eliminate delay, the order requires reimbursement "within 2 days of proof of payment."
Education is treated as non-negotiable. The court made it clear that the father must cover "all expenses relating to the minor child's education," including school fees, aftercare, transport, books, stationery and extracurricular activities.
In addition to these obligations, the court ordered, "The respondent shall pay maintenance in the amount of R37 000 per month," to be paid into an account nominated by the mother on or before the first day of each month.
Legal costs and access to justice
The court addressed the financial imbalance between the parties directly, ordering, "The respondent shall pay a contribution towards the applicant's legal costs in the amount of R350 000 within 7 days," ensuring that the mother is not placed at a disadvantage in the litigation.
The father was also ordered to pay the costs of the main application.
