The Western Cape High Court has ruled that homeowners associations building plan compliance must be enforced consistently, but without deviation from constitutional mandates.
The case, rooted in the enforcement of architectural regulations within private developments, saw Judge LG Nuku overturn the Whale Rock Heights Homeowners Association (WRHHA)'s approval of non-compliant building plans.
Regulatory violations and legal challenge
At the centre of the dispute was homeowner Thanapal Pillay, who challenged WRHHA’s authorisation of building plans for a residence on Erf 8. The plans failed to comply with the estate’s architectural guidelines, most notably a roof pitch below the required 17.5°, a key feature in maintaining the development’s aesthetic integrity.
Despite the non-compliance, WRHHA’s Board of Trustees approved the plans on 23 July 2023, sparking backlash from Pillay and other concerned residents. The dispute escalated when WRHHA, on 18 February 2025, attempted to retrospectively condone the violation, without a formal application for leniency.
Governance standards and court findings
In her 28 May 2025 judgment, Judge Nuku ruled that WRHHA’s trustees had exceeded their constitutional authority. The judge emphasised that homeowners associations must apply their own guidelines consistently, without discretionary approval of violations.
“By approving building plans that deviated from established requirements, the committee acted contrary to its constitutional obligations,” Judge Nuku stated.
The court further determined that WRHHA lacked the authority to grant condonation for non-compliance without a formal application. “In the absence of an application for condonation, any discretionary powers to grant such were not engaged,” the judgment held.
Legal and financial consequences
As a result, the court set aside all approvals related to the disputed building plans and ordered WRHHA to cover legal costs, including expert witness fees.
