The Equality Court of South Africa, Western Cape Division, has ruled that Mark Preyer must cover the legal costs associated with his racially abusive behaviour toward hospital staff.
The case originates from an incident in a triage room, where Preyer, seeking medical care, allegedly verbally assaulted Nurse Agreenet Funeka Mayongo, using racial slurs and abusive language. Overwhelmed and visibly shaken, Mayongo was replaced by another nurse, who also faced hostility. Security personnel later removed Preyer from the hospital after providing basic emergency treatment.
The court’s order mandates immediate payment of costs tied to the viewing of video footage, alongside further legal expenses from the hearing on 22 April 2025. Most notably, a warrant for Preyer’s arrest has been issued due to his failure to comply with court proceedings.
Mayongo testified about the harrowing encounter, detailing how Preyer directed racial slurs at her, calling her a “k****” and a “f**** b****.” Witnesses confirmed that Mayongo was replaced due to emotional distress, and the second nurse also faced aggression, with Preyer calling her a “f**** racist” upon being informed of his medical care limitations.
During legal proceedings, Preyer opted to represent himself, yet failed to attend a scheduled viewing of audio-visual evidence, instead sending his daughter in his place. He later submitted a late email from Greece, attempting to present a defense, yet his absence from court remained unexplained.
Judge DM Thulare condemned Preyer’s conduct as contempt of court, stating: “There is no reasonable excuse for the respondent’s failure to remain in attendance throughout the inquiry… The rule of law demands that all people subject themselves to due process.”
The case is set to reconvene on 3 June 2025, potentially proceeding in Preyer’s absence.
