Dear Conviction. I am an upcoming musician from Pretoria and my stage name is Khutsi Sdumane.
My idol, Dr Malinga, who I always looked up to, has stolen my song. The beat, lyrics, melody and vocal arrangement as well as the title of the song is the same as mine.
I’m saddened because I am a fan of Dr Malinga’s music and I have always been emulating him in my songwriting and singing style. What legal recourse do I have in all this?
The Legal Resources Centre advices
Basically if Khutsi Sdumane didn’t write the song, then Dr Malinga would be within his right to use it. And if there is no copyright, then the matter must be discussed further to unpack any rights attached to the song.
Going forward, lawyers must mediate in this matter; such cases have to be mediated between the parties, and where there is no resolution, they can take it further depending on the facts and prospects of success.
