The official process for expungement begins with the submission of a specific application to the Directorate Legal Process within the Department of Justice and Constitutional Development. Aspiring candidates must complete Form J744 — readily accessible for download online. Applications can be submitted either through the mail or in person at the designated Pretoria address:
- Directorate Legal Process, Department of Justice and Constitutional Development, Private Bag X 81, Pretoria 0001.
- Physical address: Pretmed Building, 319 Pretorius Street, Pretoria.
Once submitted, applicants should be aware that processing can take up to 75 days. It is crucial to note that any inquiries made before this timeline may lead to delays, hence applicants are encouraged to direct questions to the dedicated email expungements@justice.gov.za where responses are typically provided within five working days.
Eligibility for expungement hinges on several criteria. Candidates must demonstrate a decade of good conduct following their original conviction, with no significant subsequent offences. More specifically, the offences in question must comply with the provisions outlined in Section 271B(1) of the Criminal Procedure Act. Notably, individuals who have been sentenced to direct imprisonment or fined in excess of R20,000 are disqualified from this opportunity for erasure.
The significance of obtaining an expungement cannot be overstated; it opens doors to improved employment prospects and restores a sense of dignity to individuals seeking reintegration into society. The expungement process is entirely free of charge, making it an accessible route for South Africans eager to reclaim their lives after their mistakes.
Additionally, for minors, the Child Justice Act, 2008 (Act 75 of 2008) presents an analogous option for expunging records, ensuring that childhood missteps do not impede their futures. This legislation provides a structured approach for parents or guardians to advocate for their children, reinforcing the belief in second chances.
Understanding the criteria necessary for this second chance is imperative:
- A 10-year interval post-conviction must be evident.
- Candidates should not have faced imprisonment without the option of a fine for this duration.
- Acceptable sentences for consideration include corporal punishment, fines not exceeding R20,000, and various forms of suspended sentencing.
However, the path to expungement is not available for everyone. Individuals with unresolved convictions, those who faced direct imprisonment, or fines exceeding R20,000, do not qualify. Additionally, if a person's name appears on the National Register for Sex Offenders or the National Child Protection Register without proof of removal, they are also ineligible.

I need help I applied for police clearance,as my finger prints we taken but the case of Assault was terminated during the day of arrest ,I was not seen guilty and I never appeared in court or pay any fine , so I want to apply for expungement, how can I apply for it?
