The National Prosecuting Authority (NPA) has issued a strong call to survivors of gender-based violence (GBV) across South Africa, encouraging them to seek justice regardless of when the abuse occurred.
This message follows several rulings, demonstrating the country’s commitment to protecting victims and ensuring perpetrators are held accountable, during the week ending 13 June 2025.
The Bloemfontein Regional Court sentenced a 51-year-old man to life imprisonment for raping his 10-year-old niece in 2012. Despite the survivor’s prolonged silence due to fear, her eventual disclosure to a social worker in 2024 led to the successful prosecution of the offender. At the time of the crime, the accused was on parole for a prior rape conviction, further proving his predatory nature. The court’s decision underscores the importance of survivor testimony in securing justice, even years after an offence.
Serial rapist convicted: East London Court exposes years of terror
The Eastern Cape Division of the High Court convicted Lwando Sfiso Phike, 32, on multiple charges, including eight counts of rape and four counts of robbery with aggravating circumstances. Between 2017 and 2022, Phike preyed upon women and girls, threatening them with a knife before subjecting them to violent sexual assault and theft. Despite previously being sentenced for rape between 2016 and 2020, his continued offences highlight the urgent need for stringent legal repercussions for repeat offenders.
Scholar transport betrayal: Driver sentenced for raping learner
The Protea Magistrates’ Court sentenced scholar transport driver Retshidisitsoe Moletsane, 39, to life imprisonment for raping a 16-year-old learner entrusted to his care. His abuse of trust and repeated sexual violence led to severe emotional distress for the victim, culminating in suicide attempts. Prosecutor Mmakgadi Mangena emphasised that the only appropriate sentence was life imprisonment, ensuring Moletsane could never endanger another child again.Â
Father sentenced for child exploitation and trafficking
In a harrowing case, the Paarl Regional Court sentenced a father of three to 35 years’ direct imprisonment for trafficking his own children for online exploitation. Convicted on multiple counts, including rape and possession of child pornography, the accused deliberately created and sold illicit content for financial gain. Authorities acted swiftly following a tip-off from an undercover FBI investigator, leading to his arrest and prosecution.
This case underscores the critical role of global law enforcement collaboration in tackling child exploitation. Through intelligence-sharing, South African authorities responded to the FBI's alert, ensuring swift legal action against the offender. Such partnerships are vital in addressing the evolving landscape of online crimes and protecting vulnerable children from predatory networks.
