Raped at home: When parents become predators and silence becomes complicity

• A Benoni father is denied bail after DNA confirms he impregnated his 15-year-old daughter. 
• In Eldorado Park, a 4-year-old girl is raped and murdered; both parents now face charges. 
• In Limpopo, a man is sentenced to life imprisonment for raping his 13-year-old niece. 

In the span of days, three courtrooms across South Africa heard testimonies that shook the conscience of the nation.  

These were not crimes committed by strangers; they were acts of violence carried out within the supposed safety of the home, by men entrusted with care. The victims were a 15-year-old girl, a 4-year-old child, and a 13-year-old niece. The perpetrators: their own father, stepfather, and uncle. The enablers: silence, disbelief, and systemic failure. 

Tsakani: A father rapes, impregnates, and is denied bail 

The Tsakani Magistrates’ Court denied bail to a 39-year-old father from Lindelani, Benoni, charged with repeatedly raping his daughter beginning in March 2022. She was 15. The abuse allegedly occurred while the mother was away at church.  

On the day of the first incident, the father sent the younger brother to the shops, locked the door behind the girl, and raped her. She disclosed the assault immediately. Her mother refused to believe her. 

The abuse continued. The girl eventually fell pregnant. The mother allegedly attempted to abort the pregnancy using a concoction. When that failed, the parents sent the girl to Limpopo, where she gave birth in December 2022. After turning 18, she opened a case. 

DNA evidence confirmed the accused as the father of the child. The investigating officer testified that the accused later traveled to Limpopo to confront the victim after she spoke out on social media. Magistrate Tebogo Lekgau denied bail, citing the strength of the state’s case, the severity of the charges, and the risk of witness interference. She condemned both parents, stating that the child was failed not only by her father’s repeated assaults but by her mother’s refusal to protect her. 

Eldorado Park: A child raped and murdered while her mother remained silent 

In Protea Magistrates’ Court, a couple appeared following the rape and murder of their 4-year-old daughter. The father faces charges of murder, rape, compelled rape, child abuse, and assault. The mother is charged separately for failing to report the abuse, despite knowing it was happening. 

The case came to light after a neighbor heard the child screaming and captured a video of the father allegedly beating her. The footage went viral, prompting police intervention. The child later died in hospital. 

The National Prosecuting Authority expressed grave concern over the rising number of cases involving parental abuse and murder, reaffirming its commitment to protecting children and ensuring justice. 

Polokwane: Uncle sentenced to life imprisonment for rape of 13-year-old niece 

In Limpopo, the Polokwane Regional Court sentenced a 29-year-old man from Bergenk to life imprisonment for the rape of his 13-year-old niece. The assaults occurred between May and July 2020, twice at the victim’s home and once at her grandmother’s house. Each time, the child was alone. The accused threatened her with a knife and scissors and warned her not to tell anyone. 

She eventually confided in her aunt, and the matter was reported to police. The accused pleaded not guilty, but prosecutor Vhodzulaho Mukosi led compelling testimony from the victim, two aunts, and a medical expert. 

In aggravation, the state argued that the accused had violated the dignity and privacy of a child he was meant to protect. His lack of remorse and refusal to plead guilty were cited as reasons not to deviate from the prescribed minimum sentence. Magistrate Felleng Ntilane agreed, stating that the victim suffered in a humiliating manner and that there were no substantial or compelling reasons to impose a lesser sentence. 

Limpopo’s Director of Public Prosecutions, Advocate Ivy Thenga, welcomed the sentence and commended the work of both the prosecutor and the investigating officer, Sergeant Moreroa. 

The failure is systemic 

The Sexual Offences and Related Matters Amendment Act 32 of 2007 mandates the reporting of sexual offences against minors. In two of these cases, mothers failed to act. In all three, the perpetrators were family members. Whether out of fear, denial, or misplaced loyalty, silence became complicity.
