The Free State High Court in Bloemfontein has ordered Mafube Municipality officials to pay over R14.7 million in missing pension fund contributions.
Additionally, the officials face personal liability and possible criminal charges for misappropriation of funds dating back to 2011. This decision comes as a response to the municipality's long-standing failure to remit pension contributions deducted from employee salaries.
In the ruling, Judge M Opperman underscored the unauthorised appropriation of the employees' pension contributions, exploring the personal liability of key municipal officials in the matter. The defendants, including the municipal manager, the chief financial officer, the executive mayor, and the administrator, are now jointly and severally liable for the debt accrued during their tenure.
The legal action initiated by the Municipal Workers' Retirement Fund highlights an undeniable mismanagement of funds by the municipality, which has evaded its legal payment responsibilities under the Pension Funds Act. Judge Opperman noted a troubling pattern of the municipality challenging every claim in court rather than addressing the non-payment of pension funds effectively, indicating a deep-rooted systemic issue within municipal governance.
The Municipal Workers' Retirement Fund successfully argued that the municipality repeatedly disregarded court orders to pay these contributions, provoking significant concerns regarding the rights of the employees affected by this chronic mismanagement.
For the affected employees, many of whom have served the municipality for decades, this judgment represents a crucial step towards securing their retirement futures. According to retirement fund representatives, the non-payment of contributions has already impacted several retired workers who now face reduced pension benefits.
In a stern admonition, the judge expressed dismay over the municipality's failure to respond to prior requests for payment and its lack of accountability in recent hearings. In addition to the substantial financial penalties, the court mandated the Registrar to submit a copy of the judgment to the Director of Public Prosecutions for further investigation. This step raises the possibility of criminal charges against the municipal officials.
