Yes, it is possible to get divorced without using a lawyer in South Africa, but this option is appropriate only in limited circumstances.

While the law allows individuals to represent themselves, self-help divorce should only be considered when the matter is straightforward and free of disputes.

A self-help divorce should be pursued only when the divorce is uncontested, and both spouses agree on all key issues. This includes arrangements for minor children, dividing property and debts, spousal maintenance, and any pension interests.

If a divorce becomes contested or complicated at any stage, seeking legal representation is strongly advisable to protect one’s rights and avoid long-term consequences.

Divorce proceedings without a lawyer are generally initiated in a Regional Court. However, jurisdiction is a critical requirement. A court has jurisdiction if either spouse is domiciled in its area, meaning it is regarded as their permanent home, or if either spouse is ordinarily resident in that area and has lived in South Africa for at least one year before starting the divorce.

If there is uncertainty about which court has jurisdiction, it is best to approach the nearest court for guidance before filing any documents. Filing in the wrong court can cause unnecessary delays and complications.

While self-help divorce may seem simpler and cheaper, it is only appropriate when both parties fully understand and agree on all legal consequences.
