The Specialised Commercial Crime Court in Mmabatho has sentenced Gaananngwe Shadrack Kgosiemang, 58, to direct imprisonment for 11 counts of theft.

The court imposed a 10-year prison sentence, with five years suspended, effectively ensuring that Kgosiemang will serve a minimum of five years behind bars for his fraudulent actions while managing the Motswedi Village Bank near Zeerust.

The charges against Kgosiemang followed a lengthy investigation revealing his manipulation of financial transactions during his tenure as bank manager. Tasked with promoting the bank and overseeing its operations, Kgosiemang abused his position of trust by misrepresenting crucial financial data and approaching a co-signatory under false pretences. The court heard that he fraudulently issued cheques purporting to benefit clients, a deceptive act that ultimately led to the misappropriation of over R500,000 from the bank's accounts.

Between 30 October 2018 and 3 May 2019, Kgosiemang executed numerous unauthorised transfers from the bank's business account into his personal account. His criminal enterprise went unnoticed until an investigation was launched, leading to his arrest on 29 March 2023. Following his arrest, Kgosiemang was released on R5,000 bail, only to find himself facing the rigours of the judicial process as he pleaded not guilty to all charges against him.

During the sentencing hearing, State Advocate Matshidiso Ramakgaphola presented a poignant Victim Impact Statement from Motswedi Village Bank. The statement underscored the profound impact of Kgosiemang’s actions on the institution, detailing how the bank was ultimately placed under judicial management, a step necessary to address the fallout from his extensive theft.

Dr Rachel Makhari, the Director of Public Prosecutions in the North West, welcomed the sentence, highlighting its potential to deter future offenders. "This case reinforces our commitment to combating commercial crime and serves as a warning to anyone considering similar actions," she stated.
