The High Court of South Africa's Mpumalanga Division has re-emphasized the strict legal and constitutional framework surrounding eviction proceedings.
The court dismissed an application by the Emakhazeni Local Municipality to evict Steven Piet Ngubeni and other unidentified occupiers from it's property in Extension 2, Belfast, holding that the municipality had failed to meet required legal standards.
The crux of the Belfast, Mpumalanga, municipality's argument rested on claims that Ngubeni had unlawfully occupied the property after his employment with the municipality had ended in July 2008. The court heard that a sale agreement allowing Ngubeni to purchase the property had lapses owing to non-payment, thus leading the municipality to deem him an unlawful occupier. The municipality sought not only to evict Ngubeni and his co-occupiers but also demanded payment of outstanding rental and taxes amounting to over R130,000.
However, the court's judgment highlighted several procedural deficiencies in the municipality's case. Firstly, it noted that the municipality failed to provide evidence that alternative accommodation was available, as mandated under section 6(3) of the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act and under the Constitution of South Africa.
In the proceedings, Ngubeni argued that the eviction would be unjust, especially as it would violate his right to adequate housing. He pointed out that he believed he still held a valid sale agreement with the municipality and that the eviction sought would disrupt not only his life but that of other occupants— including his wife and friends— who are residing at the property.
The ruling underscored the importance of ensuring that eviction applications adequately consider the circumstances of all occupiers involved. The court acknowledged critical legal principles such as the necessity of engaging all parties affected by the eviction and ensuring the provision for those who might be rendered homeless by such actions.
"The constitutional framework guides that no one may be evicted from their home without an order from the court that duly considers all relevant circumstances," the judgment stated, reflecting broader constitutional obligations to protect against arbitrary evictions.
The court also pointed out that the municipality had not taken proper steps to ascertain the identities of all occupants, which further weakened its position. The ruling emphasized that everyone living on the property had not been properly notified of the eviction application, raising significant concerns around procedural fairness.
Ultimately, the court highlighted the need for state organs to conduct thorough evaluations before initiating eviction proceedings, stressing that compliance with legal requirements is pivotal for the protection of residents' rights.
