SAHRC challenges business owner Dawood Lagardien over LGBTQ+ discrimination signage

The South African Human Rights Commission (SAHRC) has announced it will proceed with legal action against Dawood Lagardien, a businessman accused of discriminatory practices against the LGBTQ+ community.

The case centres on a signage displayed outside Lagardien’s establishment, which boldly states, “LGBTQ not welcome at LaGardi – Save our children.” This message is seen as a direct attempt to exclude individuals identifying as LGBTQ+ from accessing services offered by his business.

In addition to the signage, Lagardien has allegedly played an active role in inciting discrimination through the creation and management of a WhatsApp group titled “Our Rights – anti LGBTQ+.” This group reportedly disseminates harmful statements and materials targeting LGBTQ+ individuals, raising significant concerns regarding hate speech and harassment.

Legal ramifications and SAHRC’s role

Following a thorough evaluation of the complaints lodged against Lagardien, the SAHRC has concluded that his actions potentially violate sections 10 and 11 of the Promotion of Equality and Prevention of Unfair Discrimination Act, 2000. The commission emphasises that such behavior undermines the core values of equality and non-discrimination foundational to South African society.

A hearing is set to take place at the East London High Court, functioning as an Equality Court, on 26 May 2025 from 9.30am. The venue is located at 4 Warren Road, Vincent, East London, 5217. “This hearing is not just a legal formality, it stands as a crucial test for the country’s commitment to promoting equality and protecting the rights of all citizens, regardless of sexual orientation,” the SAHRC said in a statement.
