The ownership rights to the troubled Tammy Taylor Parkview franchise have been handed to California Nails Pretoria East (Pty) Ltd amid a heated dispute with former owner Samson Adeyemi.
The Gauteng High Court, Pretoria presided over by Acting Judge SM Wentzell, granted the applicant’s urgent interdict to prevent Adeyemi from further interfering with the business operations at the Parkview Shopping Centre in Pretoria.
The case emerged when Lerato Maphike, representing California Nails Pretoria East, attempted to secure ownership of the franchise after engaging in a contentious purchase deal believed to be valid. Initial negotiations involved Adeyemi’s company, ASO Services (Pty) Ltd, entering into an agreement with Tammy Taylor Global Franchising through their representative, Petrus Viljoen. Maphike’s intention was to purchase the franchise for R1.5 million, which included a licence fee. However, confusion arose over payment direction and responsibilities between involved parties.
As the conflict escalated, Adeyemi frequently visited the business, demanding proofs of payment and ultimately shutting down operations on October 16, 2024, citing unpaid dues. His actions culminated in a forceful eviction of Maphike and her team from the premises, leading them to seek judicial intervention.
The court concluded that despite Adeyemi’s claims that he was unaware of any sale agreement taking place, evidence indicated he had granted authority to Tammy Taylor Global Franchising to manage the business’s sale on his behalf. Disputes of fact that emerged were decisively settled in favour of Maphike, with the judge underscoring that Adeyemi’s real remedy lay with Viljoen and Tammy Taylor Global Franchising, and not Maphike, thereby quashing his claims to seize the business.

Judge Wentzell’s ruling not only resulted in the affirming of the sale agreement’s validity but also instructed Adeyemi, Viljoen, and Tammy Taylor Global Franchising to ensure seamless transfer of all operational rights related to the franchise to California Nails Pretoria East. Furthermore, it mandated that they undertake necessary actions to transfer the lease associated with the business premises—a simple yet significant mandate considering ongoing challenges in tenancy agreements prevalent in commercial disputes.
